Fresh House — Terms of Service

1. Purpose of the Service

Fresh House is a community-powered platform designed to preserve and display historical property records, including inspections, reports, photos, notes, and observations ("Property Records").

Fresh House is not a substitute for professional inspections, disclosures, or due diligence. Property Records are provided for informational purposes only.

2. Eligibility

You must be at least 18 years old to use the Service. By using Fresh House, you represent that you meet this requirement.

3. User Accounts

Some features may require an account; others may allow anonymous contributions.

You are responsible for:

• The accuracy of information you submit
• Maintaining the security of your account
• All activity associated with your account

Fresh House may suspend or terminate accounts that violate these Terms.

4. User Content

a. Ownership

You retain ownership of content you submit ("User Content").

b. License Grant

By submitting User Content, you grant Fresh House a perpetual, irrevocable, worldwide, royalty-free license to host, store, reproduce, display, distribute, and preserve such content as part of a property's historical record, subject to applicable law.

This license survives account deletion.

5. Content Permanence & Historical Integrity

Fresh House preserves Property Records as part of a historical archive intended to protect future buyers and the public.

By submitting content, you acknowledge and agree that:

• Property Records are intended to be permanent
• Records cannot be removed solely due to regret, preference, or change of circumstances
• Fresh House is an append-only system, not an editable feed

This permanence is essential to prevent misleading gaps in property history.

6. Corrections, Redactions, and Disputes

Fresh House does not provide self-service tools to delete Property Records.

Users may request review for:

• Factual inaccuracies
• Privacy or safety concerns
• Sensitive personal information
• Legal compliance issues

Fresh House may, at its discretion:

• Redact sensitive details
• Add clarifying context
• Mark records as disputed
• Restrict public visibility
• Remove content if legally required

All requests are reviewed manually. Approval is not guaranteed.

7. Prohibited Content

You may not submit content that:

• Is knowingly false or misleading
• Infringes intellectual property rights
• Contains threats, harassment, or hate
• Exposes sensitive personal information
• Violates applicable laws

Fresh House may remove or restrict content that violates these rules.

8. No Self-Service Removal

Fresh House does not allow users to delete, archive, or erase submitted Property Records through the user interface.

Requests for modification or review must be submitted through official Fresh House contact channels.

9. Prohibited Uses & Scraping

You may not:

• Scrape, crawl, or harvest data from the Service
• Use automated tools to extract content
• Bulk download or resell Property Records
• Reproduce or republish data for commercial use
• Attempt to reverse engineer the Service

Fresh House reserves the right to block access, throttle usage, or pursue legal remedies for unauthorized data extraction.

10. Intellectual Property

The Fresh House platform, design, trademarks, logos, and software are owned by Fresh House and protected by law.

Except for User Content, nothing on the Service grants you rights to Fresh House intellectual property.

11. Disclaimers

Fresh House does not verify, inspect, or guarantee the accuracy of Property Records.

All content is provided "as is" and "as available."

You assume all risk associated with reliance on the Service.

12. Limitation of Liability

To the fullest extent permitted by law, Fresh House is not liable for:

• Inaccuracies in User Content
• Decisions made based on Property Records
• Loss, damage, or disputes arising from use of the Service

13. Indemnification

You agree to indemnify and hold harmless Fresh House from claims arising from:

• Your use of the Service
• Your submitted content
• Your violation of these Terms

14. Account Termination

Fresh House may suspend or terminate access at any time for violations of these Terms or misuse of the Service.

Account deletion does not remove Property Records previously submitted.

15. Changes to These Terms

We may update these Terms periodically. Continued use of the Service constitutes acceptance of changes.

16. Governing Law

These Terms are governed by the laws of the United States and the applicable state jurisdiction, without regard to conflict-of-law principles.
